Specific power for acquiring property
The specific power to acquire property is delegated to the Service Manager Property Procurement, in accordance with Part 7.2, 6.6 of the Constitution.

This was introduced by the report to the Executive dated 26 November 2002, entitled "Review of procedures for the acquisition and disposal of property". A copy of the report (and the resolution) is available on Review of procedures for the acquisition and disposal of property (A003/1).
The acquisition of land should be in accordance with the Financial Procedure Rules of the Constitution.
Financial Procedure Rules
Expenditure will need to have been authorised either by the Cabinet or by a Director or Service Manager under delegated powers, in accordance with the Financial Procedure Rules contained in Section 8.2 of the Constitution.
Contract Procedure Rules
The general requirements of the Contract Procedure Rules for tendering, etc, do not apply to the acquisition of property.
