The Local Government Ombudsmans guidance entitled 'Disposal of land - Guidance on good practice 5' - This guidance is currently under review and will be linked as soon as it is available.

The Crichel Down rules as referred to in the Good Practice Guide were revised in 2004 and can be found at - www.communities.gov.uk/publications/planningandbuilding/circularcompulsorypurchase2.

The principal changes (Rule 16) require former owners to be notified if they are NOT going to be offered the land back either because it has materially changed or falls within the exemptions in rule 15 a new Rule 28 which requires a central record or file to be kept clearly recording a note of the consideration of the rules and whether they apply or not, and if not why not. This should be held on both the file and Evolut1on, the county councils property database.
